State v. D.G. – .084 breath test

A city of Lawrenceville officer stopped D.G. for driving in the turn lane in excess of 300 feet “from the next possible left turn.”  The law states that motorists may not drive in the turn lane more than 300 feet.  Mr. Ryczek proved that every point on that particular road provided motorists the ability to turn within 300 feet, and therefore the officer's rendition of the events was not accurate, and the State would have a difficult time proving that the officer stopped D.G. legally.  Mr. Ryczek convinced the prosecutor to reduce the DUI to Reckless Driving.
